On 7 November 2018, additional legislation changes were announced to strengthen the My Health Record Act.
In summary, the changes include:
- Increasing the penalty for improper use of a My Health Record from two years to five years and the maximum penalty will double to $315,000.
- An individual cannot be an authorised representative of a minor if they are posed as a threat to the child or person associated with them. This also applies if they have restricted access to the child.
- Employers will be prohibited from requesting and using information on a person’s My Health Record. Importantly, employers or insurers cannot avoid the prohibition by asking individuals to share their record.
- Information on a person’s My Health Record will not be released to private health insurers for the purposes of research or public health.
